For Immediate Release: Compliance with New Regulations still awaited from Lincoln and Omaha Omaha, NE, July 14th, 2010 – New firearms laws go into effect Thursday July 15th as a result of LB 817 passing in the Legislature this year. The City of Omaha was scolded by members of the Unicameral for ignoring the law passed in 2009 regarding handgun registration. Nebraska Concealed Handgun Permit holders cannot be forced to register their handguns, so LB 817 further clarified this to bring Omaha into compliance with the state law. The City of Omaha has not yet given direction to Firearm Dealers on how to transfer ownership of a handgun to a Concealed Handgun Permit Holder now that they are not required to register their firearms. It is also still to be determined how the registration system of Lincoln, Nebraska will be adjusted to comply with this legislation. LB 817 also should allow NE Concealed handgun permit holders as well as law enforcement officers to bypass the need for a firearm purchase certificate from the county sheriff; however this is still pending final approval by the Bureau of ATF. Finally LB 817 set a 10 year time frame for disqualification of a concealed handgun permit for those individuals convicted of misdemeanor crimes of violence. For Immediate Release: Nebraska Firearms Owners Association Announces Leadership Conference Omaha, NE, July 8th, 2010 – Andreas Allen, President of the Nebraska Firearms Owners Association (NFOA) announced today a Leadership Conference will be held Saturday July 17th at the Hilton Garden Inn, 1005 Dodge St. Omaha, NE. This event will feature Alan Gottlieb, founder of the Second Amendment Foundation and Chairman of the Citizens Committee for the Right to Keep and Bear Arms. The conference is jointly sponsored by the NFOA and the aforementioned organizations. The SAF was the originator of the McDonald v. City of Chicago case that recently was heard by the U.S. Supreme Court and ruled on in favor of the Citizens of America. The Leadership Conference will involve grassroots organizing, communication, and activism on State and National Gun Rights issues. The Second Amendment Foundation (www.saf.org) is the nation's oldest and largest tax-exempt education, research, publishing and legal action group focusing on the Constitutional right and heritage to privately own and possess firearms. For Immediate Release: Nebraska Firearms Owners Association calls upon the City of Omaha to Abide by State Law Concerning Registration of Concealable Firearms Omaha, NE, March 26, 2010– Andreas Allen President of the Nebraska Firearms Owners Association (NFOA) urges the City of Omaha, NE to comply with state law, and end their practice of requiring licensed concealed handgun permit holders to register firearms. An opinion released today by Attorney General Jon Bruning states that “the Concealed Handgun Permit Act, as amended by LB430 in 2009, pre-empts municipal bans on the carrying of concealed handguns.” In LB430 (now Neb. Rev. Stat. 18-1703) it states: “Cities and villages shall not have the power to regulate the ownership, possession, or transportation of a concealed handgun, as such . . . is authorized under the Concealed Handgun Permit Act . . . Any existing city or village ordinance . . . is declared to be null and void.” The Omaha ordinance, which prohibits the possession of unregistered concealable firearms, violates this pre-emption as it applies to those who possess a valid carry permit recognized by Nebraska. This falls within the obvious meaning of this language. We expect the City of Omaha to bring itself within compliance immediately and stop requiring concealed handgun permit holders to register their concealable firearms. The Nebraska Firearms Owners Association has been pushing for recognition of this fact by the Omaha Police Department and the City Attorneys’ Office since the passage of LB430 last year. For Immediate Release: Nebraska Firearms Owners Association Announces Support for “Castle Doctrine” Lincoln, NE, January 11, 2010 – Self defense is a God given right for all mankind. But here in Nebraska, if you are required to use force to defend yourself or someone you love, you could find yourself caught in a legal quagmire that can cost you and your family thousands to defend your actions in court. The Lancaster County Attorney Gary Lacey has stated: "Changing the law so people shoot without hesitation could lead to people killing a family member coming home late or a person pounding on the door in the middle of the night seeking help". What is Mr. Lacey basing this assumption on? Is this the case in other 23+ states that have similar laws? Of course not. The standard for when you can use force is still pretty clear. You cannot shoot someone because they are pounding on your door. You are justified in using deadly force to protect yourself or your families only if you believe you are facing death, serious bodily injury, kidnapping or sexual assault. You cannot “shoot without hesitation” under current law, and you will not under the law being proposed by State Sen. Mark Christensen of Imperial. Further, Mr. Lacey was quoted in the Omaha World Herald stating that the Prosecution must prove beyond a reasonable doubt that a person was not justified in using deadly force. That is absolutely not true, because when a person claims “self defense”, they are taking what is called the “affirmative defense” meaning that they admit to committing homicide, however they were justified. The burden of proof in an affirmative defense lies with the person who used deadly force. They must now prove they were justified in using deadly force, not the other way around as Mr. Lacey stated. What is really not right with Nebraska's current law is even though a homeowner defends themselves against an intruder in their house, and they are found to be justified under criminal law, the homeowner can still be sued in a civil court by the criminal (if just injured) for personal injury compensation or by the criminal’s survivors for wrongful death. While such suits are typically not successful, how would you like to spend your life savings or sell your home to defend yourself against these baseless lawsuits just because you were defending your family in your own home? When someone makes a decision to be a criminal and break into someone's home, they should not have any course of civil action. Senator Christensen's proposed changes do not loosen the standard for using deadly force in Nebraska. . The change offer further protections to the homeowner defending their lives and takes away the potential civil actions. Calling this proposed law the "Make My Day Law" or the "Shoot Your Neighbor Law" can only be done by someone who is completely uninformed on this issue. The proposed changes accomplish three things: One: It establishes, in law, the presumption that a criminal who forcibly enters or intrudes into your home or occupied vehicle is there to cause death or great bodily harm, so the occupant may use force, including deadly force, against that person. Two: It removes the "duty to retreat" if you are attacked in any place you have a right to be. You no longer have to turn your back on a criminal and try to run when attacked. Instead, you may stand your ground and fight back, meeting force with force, including deadly force, if you reasonably believe it is necessary to prevent death or great bodily harm to yourself, your family, or others. Three: It provides that persons using force authorized by law shall not be prosecuted for using such force. It also prohibits criminals and their families from suing victims for injuring or killing the criminals who have attacked them. In short, it gives rights back to law-abiding people and forces judges and prosecutors to focus on protecting victims. A lawmaker who opposes Senator Christensen's Castle Doctrine legislation is representing the criminals’ interests more so than they are representing the honest, hard working, law-abiding citizens of Nebraska.
